Heard learned counsel for the petitioner and the learned Standing Counsel for the respondent no. 3.
The petitioner contends that the recommendations which have been made on 12th September, 2017 by the Commissioner himself, and which is pending before the State Government, if decided at the earliest, would also decide the fate of the appeal which is pending before the learned Commissioner.
In this regard we find that the map cancellation order is under challenge before the Commissioner and with regard to the policy which is to be adopted, the recommendations are also pending before the State Government.
Consequently, the learned Standing Counsel submits that the respondent no. 2 shall take an appropriate decision in the matter and intimate it to the Commissioner at the earliest in case no such decision has already been taken.
We, therefore, dispose of the writ petition with a direction to the respondent no. 2 to take a decision on the recommendation made by the Commissioner dated 12th September, 2017, copy whereof has been filed as Annexure No. 1 to the writ petition and intimate its decision to the respondent no. 3 for further appropriate action as expeditiously as possible preferably within six weeks from the date of presentation of certified copy of this order before him.
Disposed of with the said direction.
