Kerala Water Authority vs S. Neeraj

High Court Of Kerala|27 October, 2000

JUDGMENT / ORDER

The water authority has filed this writ petition challenging Ext.P8 order passed by the Lok Ayukta on the ground that the complaint filed by the 1st respondent was not maintainable in as much as there was no "grievance", "allegation" or maladministration" as alleged in the complaint, as defined under Section 2(b), 2(h) and 2(k) of the Kerala Lok Ayukta Act. This Court has passed an interim order staying the further proceedings of the Lok Ayukta on 8.5.2007. By the impugned award, the Lok Ayukta directed the water authority to recompute and issue fresh invoice to the 1st respondent/complainant. It was found that the respondents-the petitioners herein had claimed water charges during which period the meter was faulty. It was observed that in such circumstances, the petitoners herein could have claimed water charges only for a period of six months before the installation of a new metre. Even though the petitoners alleged that the complaint did not contain any W.P(C) No.14557 of 2007-G 2 allegation, grievance or any averment regarding maladministration and hence was not maintainable before the Lok Ayukta, the petitioners have not produced the complaint before this Court. Under the above circumstances, this Court cannot look into the correctness of the contentions.
Under the above circumstances, I do not find any merit in the writ petition. Hence the Writ Petition is dismissed.
