JUDGMENT / ORDER

The petitioner is conducting a retail shop FL-1-8021 at Kotakara within the territorial limits of the second respondent Panchayat. The petitioner had submitted an application for the issue of a trade license for the year 2014-15. The Panchayat did not accept the application. Therefore, the application was sent by registered post. Later on the Panchayat directed the petitioner to produce certain documents by Ext.P12. The petitioner has already produced the documents. The petitioner has now been served with Ext.P13 directing to show cause why the FL-1 shop conducted by them should not be closed down. The petitioner has already submitted Ext.P14 explanation. Ext.P15 is the acknowledgment for receipt of Ext.P14. No final orders have been passed in the matter yet. The petitioner has filed this writ petition apprehending that the FL-1 shop conducted by them would be closed down without W.P.(C).No.29121 of 2014 2 considering their objections.
Heard the counsel for the petitioner. Since no action prejudicial to the interests of the petitioner has been initiated by the Panchayat so far, I am not satisfied that this writ petition requires to be admitted. It is for respondents 2 and 3 to consider Ext.P14 reply submitted by the petitioner as well as the documents produced along with Ext.P12 and to take a decision in the matter. The petitioner would be at liberty to challenge any such final order, if it is against the petitioner.
In view of the above, this writ petition is disposed of directing respondents 2 and 3 to consider Ext.P14 reply submitted by the petitioner in the light of the documents produced along with Ext.P12 and to consider and pass final orders on the proceedings initiated by Ext.P13. Until final orders are passed in the matter, no coercive action to close down the FL-1 shop conducted by the petitioner shall be initiated.
