JUDGMENT / ORDER

1. Petitioner KSRTC is aggrieved with Ext.P6 order of the RTA, Thiruvananthapuram. Admittedly, the said order was passed on the basis of Ext.P2 order of the Tribunal on an appeal filed by the third respondent herein. The third respondent before the Tribunal was aggrieved by the order of the RTA rejecting variation in a regular permit. The Tribunal allowed the appeal by Ext.P2 and RTA complied with the order of the Tribunal by Ext.P6 without noticing the fact that Ext.P2 order was set aside by this Court by Ext.P3 judgment.
2. In such circumstances, Ext.P6 order is set aside. The writ petition is allowed. However, this judgment would be without prejudice to the third respondent to seek for any variation and to take appropriate proceedings before the RTA or before the Tribunal, as advised.
