Antony Dominic, J. This appeal is filed against the judgment in W.P (C).1089/08. When the appeal came up for consideration, learned counsel for the appellant submitted that the Board has issued order No.B.O.(FB) No.1313/2011(PS1/Gratuity/TVPM/2006) dated 24.5.2011, the relevant portion of which reads thus:
“Having considered the above, the Board has decided to make applicable the Payment of Gratuity Act, 1972 to the employees of the Board as recommended by the Legal Adviser & Disciplinary Enquiry Officer and also to withdraw the Special Leave Petition filed by the Board before the Hon'ble Supreme Court of India.
The Chief Engineer (HRM) shall take further necessary steps for the payment of gratuity as per the Payment of Gratuity Act, 1972. Before effecting the payment, proper verification regarding the admissibility of balance amount of gratuity and the status of the gratuity cases pending in various courts and legal fora shall be made. The details of the entire gratuity cases will be provided by the concerned Nodal Officers, Personnel Department and Law Section.
WA.470/10 2 The Joint Secretary (Law) shall take necessary steps to withdraw the LP No.7744- 7745/2008 filed by the Board before the Hon'ble Supreme Court of India.”
In the light of the above, counsel prays that the appeal may be closed.
Since the Board itself has taken a decision, accepting the request of the counsel for the appellant, this appeal is closed.
