JUDGMENT / ORDER

The only grievance voiced in this Civil Revision Petition is that enhanced compensation has been assessed by applying the principle laid down in the decision reported in Kumba Amma v. Kerala State Electricity Board (2000(1) KLT 542) which has been overruled and the principle now applicable is the principle laid down in Kerala State Electricity Board v. Livisha ((2007) 6 SCC 792).
2. To that extent, the learned counsel for the petitioner may be correct. But it is to be noticed that no amount whatsoever was awarded for diminution in land value on the ground that no evidence has been adduced. It is true that the petitioner before the court below has not produced any evidence. But the court below was not justified in not granting any amount as diminution in land value.
C.R.P.56/2008. 2
3. As far as the enhanced compensation is concerned, it is felt that the enhanced compensation granted by the court below is quite reasonable, just and proper and no interference is called for.
This Civil Revision Petition is accordingly dismissed.
P. BHAVADASAN, JUDGE sb.
