The 2nd respondent was an employee of the appellant. He was dismissed from the service on 2.2.1991. Dismissal was the subject matter of I.D.No.22/92, which resulted in Ext.P2 award ordering his reinstatment with backwages. Again on the allegation that he was not reinstated as ordered, yet another dispute was raised and that was referred as I.D.No.72/1994. In that I.D., Ext.P4 award was passed, again ordering his reinstatment at Kozhikode with backwages. Challenging Ext.P4 award, O.P.No.21150/1997 was filed by the appellant. That was dismissed by the learned Single Judge by the impugned judgment. It is this judgment, which is under challenge before us.

After hearing the counsel for the parties, considering the fact that the issue in essence pertains to a dismissal in 1991, and having regard to the long lapse of time we thought that this is a fit case, where the parties should settle the matter. This W.A.No.507/2007 2 suggestion was welcomed by both sides. Accordingly, we suggested to the management to pay a consolidated amount of Rs.2.5lakhs to the workman in full and final settlement of all claims that he has against the management. This suggestion has been accepted by both sides.
Accordingly, this appeal is disposed of ordering that, as agreed by both sides, the appellant will pay Rs.2.5 lakhs to the 2nd respondent workman or to his counsel within two weeks from today and on such payment, the award in I.D.No.72/1994 rendered by the Labour Court, Kozhikode will stand set aside and that the said payment will be in full and final settlement of all claims that the 2nd respondent has against the appellant arising out of his employment.
Writ Appeal is accordingly disposed of as settled.
