Kerala Karshaka Samrakshana Association

The petitioner is the Kerala Karshaka Samrakshana Association. The members of the petitioner Association are in possession and enjoyment of agricultural land prior to 1.l.1977. The petitioner submits that in terms of the Land Assignment (Regularisation of Forest Land prior to 1.1.1977) Rules, the Revenue Authorities and the Forest Authorities conducted joint verification and found that the petitioners are eligible for issuance of Patta. The petitioner also relies on Ext.P2 Government Order. However, the petitioner submits that even after conducting a joint verification by the Revenue and Forest Authorities, no Patta has been issued to the members of the petitioner Association. The petitioner approached the District Collector for temporary possession certificate pending issuance of Patta.

W.P.(C) No.29786 of 2014 2 In view of the matter, the District Collector shall consider the request of the petitioner for issuance of temporary possession certificate pending issuance of Patta. Needless to say that the District Collector shall also take necessary steps in the matter for issuance of Patta after considering the claim of each member in accordance with law. The application for issuance of possession certificate shall be considered within a period of six weeks.

The writ petition is disposed of as above.
