O.S.No.76 of 2001 on the file of the Court of the Additional Sub Judge, Kottayam was filed by the Western India Plywoods Limited, Baliapatam, Kannur against the Kerala Forest Development Corporation Limited. The trial court decreed the suit in part and a decree for realisation of a sum of ₹35,56,930.66 together with interest at 9% per annum from 30.7.1998 to the date of decree and thereafter at the rate of 6% per annum till the date of realisation was granted in favour of the plaintiff. The defendant filed this Regular First Appeal challenging the judgment and decree of the trial court.
2. When the appeal came up for hearing, the matter was referred for mediation. The parties settled the disputes and a memorandum of agreement dated 10.11.2014 was signed by them. The terms of the memorandum of agreement read as follows:
R.F.A. NO.182 OF 2008 (A) :: 2 ::
“Both the parties have agreed to settle the dispute between them under the following terms and conditions:
1. Both the parties have agreed to settle the dispute as full and final settlement of the above case.
2. The appellant has agreed to pay an amount of Rs.13,00,000/- (Rupees Thirteen Lakhs only) for which an account payee cheque given by the appellant to the respondent on or before 30th November, 2014.”
In view of the settlement, the Regular First Appeal is disposed of in terms of the settlement. The court fee paid on the Memorandum of Appeal will be refunded to the appellant.
