Arabatti, Advocate) …Petitioner …Respondent This Criminal Revision Petition is filed under Section 397 r/w 401 of Cr.P.C praying to set aside the order dated 22.09.2016 passed by the XXIII Additional City Civil and Sessions Judge and Spl. Judge, Bengaluru Urban District, Bengaluru, in Spl.C.C.127/2011 and allow the Application filed by the petitioner under Section 227 of Cr.P.C and consequently discharge the petitioner from the offences punishable under Sections 120(B) and 420 of IPC and Sections 7, 13(1)(d) r/w. Section 13(2) of Prevention of Corruption Act.
This Criminal Revision Petition coming on for Admission, this day the Court made the following:-
O R D E R The learned counsel for the petitioner/accused submits that already material witnesses have been examined before the Court below and he has filed the present petition challenging the discharge application for having dismissed the same. He can urge the said grounds during the course of argument. With the above liberty he may be permitted to withdraw the petition.
The said submission is placed on record.
By keeping open the said submission, the petition is disposed of.
IA No.1/2016 does not survive for consideration.
Accordingly, the same is disposed of.
