THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER Petitioner herein is seeking mandamus to respondents for considering his application dated 6.4.2015 vide Annexure-C, wherein his prayer is to effect mutation and change of entries in RTC based on the registered sale deed dated 23.5.1977, which is at Annexure – A with reference to land bearing Sy.No.8/2 of Bhantarakuppe village, Solur Hobli, Magadi Taluk.
2. When this matter is taken up for consideration, it is seen that a memo is filed by the learned HCGP, wherein an endorsement issued by the Tahsildar, Magadi Taluk, is also annexed. The said endorsement would indicate that if all the necessary documents are produced by the petitioner, his prayer for change of katha would be considered in accordance with law.
3. In that view of the matter, this Court would direct the petitioner to approach the Tahsildar – 2nd respondent and furnish all the particulars which are sought by the authority. It is made clear that after receiving the same, the 2nd respondent shall complete the transfer of katha, if the same is in accordance with law within three months from the date of receipt of a copy of this order.
Accordingly, this writ petition is disposed of.
Learned Additional Government Advocate is permitted to file memo of appearance within two weeks from today.
