Argument is that offence under Section 326 IPC is not made out against the applicants and they have been falsely implicated in this case.

Issue notice to opposite party no.2 returnable at an early date.
Opposite parties may file their counter affidavits within six weeks. Rejoinder affidavit may be filed within two weeks thereafter.
List thereafter.
Further proceedings in Crime No. 0318 of 2017, under Sections 147, 323, 325, 326, 595, 506 IPC, Police Station Iglas, District Aligarh, pending in the Court of A.C.M.M.-VI, Kanpur Nagar, shall remain stayed against the applicants till the next date of listing.
