Heard Mr. Mata Prasad, learned Counsel for the petitioner, learned Counsel appearing on behalf of respondent nos.1, 2 and 3 and Mr. Deeptiman Singh, learned Counsel appearing on behalf of respondent nos.4, 5, 6 and 7.
Mr. Deeptiman Singh, learned Counsel appearing on behalf of respondent nos.4, 5, 6 and 7 makes a statement at the Bar that both the orders, that is to say, the order dated 21.01.2021 and 18.03.2021, annexed as Annexure Nos.1 and 2 to the writ petition, have been unconditionally withdrawn and maternity leave has been sanctioned to the petitioner. This order of withdrawal and sanction of leave has been passed on 21st May, 2021. He submits that in this view of the matter, this writ petition has been rendered infructuous. Learned Counsel for the petitioner does not dispute this position, but comes up with a prayer that costs may be awarded looking to the dereliction by the respondents in illegally refusing maternity leave to the petitioner.
Considering the over all facts and circumstances, in particular the fact that the respondents are an institution, who are engaged in taking care of the Covid-19 pandemic, this Court does think it proper to impose the costs sought for.
This writ petition is, accordingly, disposed of with a direction that the order dated 21.05.2021, now passed by the respondents, be faithfully carried out by all concerned, including the Director General, Medical Education, U.P., Lucknow, about whom it is said that the order under reference now made by respondent nos.4, 5 and 6 has not been endorsed.
Let this order be communicated to respondent nos.3, 4, 5, 6 and 7 by the Joint Registrar (Compliance) within 24 hours.
