Heard.
Petitioner states that as against the order of the Collector & District Magistrate, SPSR Nellore, dated 19.08.2014 canceling the caste certificate of the petitioner as if belonging to BC-A category, she preferred an appeal on 10.09.2014 before the first respondent- Principal Secretary along with an interim application for stay. The grievance of the petitioner in this writ petition is however that in said appeal no date is fixed and even the interlocutory application is not being taken up and thereby she apprehends that the order impugned may be given effect leading to coercive steps against her.
Since the appeal filed by the petitioner is only on 10.09.2014, the interim application therein atleast is required to be heard and disposed of by the first respondent at the earliest.
In the circumstances, therefore, the first respondent is directed to consider and decide the interim application filed by the petitioner within a period of two weeks from the date of receipt of a copy of this order and thereafter at the convenience of the 1st respondent, the appeal may be heard and disposed of on merits after serving notice to the effected parties and hearing them.
However, since the petitioner is apprehensive of coercive steps being taken against her under the guise of order of cancellation of caste certificate, particularly in the nature of prosecution, all such proceedings, if any, shall await the orders to be passed by the first respondent as directed above.
With above observations, the Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions pending in this writ petition, if any, shall stand closed.
