By means of the present petition, petitioner is seeking for quashing the transfer order dated 26.4.2018 passed by respondent no.4 as also the relieving order dated 10.5.2018 on the ground that the petitioner's wife is suffering from major heart disease and her treatment is going on in Nazreeth Hospital, Allahabad.
Considering the prescription brought on record, it is more than apparent that they are of the year 2014.
The petitioner has been promoted on the post of Junior Engineer, Minor Irrigation on 20.12.2016 and he has been adjusted in district Allahabad despite promotion. It is also brought to the notice of the Court that the petitioner has been posted in District Allahabad since the year 1981. The reference to the transfer policy is, therefore, would be of no relevance to interfere in the transfer order.
However, it is provided that in case, the petitioner joins at the place of posting pursuant to the transfer order dated 26.4.2018 passed by respondent no.4, it would be open for him to make a representation raising his grievance in detail. In that eventuality, the respondent no.2 would be under obligation to consider the claim of the petitioner and take an appropriate decision in accordance with law.
With the aforesaid observation, the writ petition stands
disposed of.
