No one appears on behalf of the petitioner to press this writ petition.
Sri S.S. Pandey holding brief of Sri Vivek Saran, learned counsel for the respondent is present.
This case is of the year 2003 and is lying dormant for the last several years. Record of the writ petition shows that no serious effort has been made by the petitioner to get the case heard.
I have perused the record.
From the record, it transpires that either cause of action does not survive or the petitioner has lost interest in pursuing the matter.
In view of the above, no fruitful purpose would be served in keeping the writ petition pending.
Accordingly, the writ petition is dismissed as infructuous with liberty to the petitioner to move recall application in case cause of action still survives or dismissal of the writ petition causes any prejudice to his interest.
Interim order, if any, stands discharged. No order as to cost.
