1. Heard learned counsel for applicant and learned A.G.A. for State.
2. Application under Section 319 Cr.P.C. submitted by applicant for summoning Smt. Sheela Devi has been rejected by XIIth Additional Chief Judicial Magistrate, Agra vide order dated 18.09.1999 and thereagainst Criminal Revision has also been rejected by Additional Sessions Judge, Agra vide order dated 03.06.2002, hence this application under Section 482 Cr.P.C.
3. It is submitted that Court below has committed error in not summoning Smt. Sheela Devi.
4. Section 319 Cr.P.C. confers jurisdiction of Trial Court to summon a person if finds sufficient material. Trial Court has not found any reason for summoning and that order has been confirmed by Revisional Court also. No material irregularity in the procedure followed by Court below has been pointed out. It is not a case of grave injustice justifying interference in this application at this stage.
5. The application lacks merit and is accordingly dismissed.
