This writ petition, at the behest of Kedar Nath son of late Bachai, will have to be disposed of as the sole applicant has died.
The proforma respondents who are also the co- accused may either file discharge or may file fresh petition challenging the order of the Court below. It is up to them to decide and if they appear before the Court below, the proceedings of Criminal Case No. 420 of 2005 under Sections 147,323,504,506,452,379, 427 and 447 of I.P.C.
and 3 (1) 10 and 5 of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act shall remain stayed for a period of four weeks from today. No coercive action shall be taken against them.
In view of the above, this petition is disposed of.
All the subsequent applications filed here are disposed of as the main petition is disposed.
It goes without saying that this Court has not entered into the merits of the case as this Court has only given permission to other co-accused to file fresh writ petition or discharge application.
