Heard learned counsel for the petitioner and learned standing counsel for State-respondents.
Present petition has been filed with following relief;
(i) Issue a writ, order or direction in the nature of mandamus commanding the respondent nos. 3 and 4 to pay the entire arrears of the salary difference in pursuance to the Government Order dated 30.01.2015 of Rs. 62226/- for the period w.e.f. January, 2006 to May 2013 to the petitioner within a stipulated period alongwith interest at the rate of 18% till the date of actual payment.
Learned counsel for the petitioner submits that for reddresal of his grievance petitioner has moved representation dated 25.08.2021 before the respondent no. 3, but till date same has not been decided. He next submitted that a suitable direction may be issued to respondent no. 3 to consider the representation of the petitioner dated 25.08.2021 and decide the same within stipulated time to which learned Standing Counsel has no objection.
Under such facts and circumstances, this petition is disposed of with direction to respondent no. 3 to consider the representation of the petitioner dated 25.08.2021 and decide the same strictly in accordance with law maximum within a period of two months from the date of production of computer generated copy of the order.
It is made clear that Court has not adjudicated the case on merits and it is upon the respondent no. 3 to decide the representation of the petitioner after considering the Act, Rules, Government Orders, Judicial pronouncement made by the Court as well as facts of the case.
