Upon hearing learned Counsel appearing for the parties, we find that petitioner's application for conversion of Nazul land to freehold land is pending before the District Magistrate, respondent no. 2 herein, since 15.6.2005. He filed an earlier application/writ petition of a cooperative society regarding the same cause in which the petitioners were the party. However, we do not want to go such factual controversy, if it is so, the State respondent will be entitled to confront the issue of the petitioner before the appropriate authority in this respect.
Therefore, we direct the respondent no. 2 to consider and dispose of the application of the petitioner dated 15.6.2005 in accordance with law as early as possible preferably within a period of two months from the date of communication of this order upon giving fullest opportunity of hearing and by passing a reasoned order thereon.
Accordingly, the writ petition is disposed of at the stage of admission on contest, however, without imposing any cost.
