The petitioner claims to be a freedom fighter. The petitioner filed an application seeking freedom fighters pension to the respondent-District Collector. The said application was rejected on 18.4.2005 stating that the document submitted to prove the age is not correct and proper. It was stated that relevant documents necessary for processing the claim have not been enclosed. Since the documents submitted along with the application was insufficient, to consider his claim, the same was rejected. 2. The petitioner thereafter made a representation to Chief Minister's Grievance Cell and the 1st respondent-Government. Considering the said claim, by proceedings No. 32559 m/m.X.-4/2005, dated 18.7.2005, the Government directed the 2nd respondent to consider the claim of the petitioner afresh. Para-2 of the proceedings reads as follow:

3. In view of the subsequent events and the direction of the Government, the relief of certiorari stands rejected as there is no order of rejection on merits. However, the petitioner is entitled to relief by way of a Mandamus directing the 2nd respondent-District Collector to consider the petitioner's claim as directed by the 1st respondent-Government for grant of State Freedom Fighters Pension.
4. If any document is required, the petitioner will be given sufficient time to produce the same. The 2nd respondent shall deal with the application with due regard to the petitioner's claim for freedom fighters pension and dispose of the matter as expeditiously as possible. The writ petition is disposed of with the above direction. No costs. Consequently, WP MP No. 46 of 2009 is closed.
