JUDGMENT / ORDER

The petitioner has filed this writ petition challenging Ext.P16 proceedings of the respondent. As per Ext.P16, the petitioner has been directed to show cause why action should not be taken against the Bank under Section 32 of the Kerala Co-operative Societies Act, 1969 (hereinafter referred to as “the Act” for short). According to the learned counsel for the petitioner, the impugned proceedings are motivated. They apprehend that, a final order would be passed under Section 32 of the Act without considering the objections raised by the petitioner.
2. The learned Government Pleader assures that the petitioner would be granted an opportunity of being heard and that a final order would be passed only after considering the explanation submitted. It is not in dispute that the petitioner has already submitted an explanation.
In view of the above, this writ petition is disposed of directing the respondent to consider the objections/explanation submitted by the petitioner, to afford an opportunity of being heard to all concerned and to take a final decision in the matter only thereafter.
