THIS R.P.F.C. COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER The petitioner and respondent are present before the Court.
2. Learned counsel for the petitioner submitted that the matter is settled before the Mediation Centre. In pursuance of the earlier order passed in this case Rs.1,00,000/- was deposited before the Court. As per the terms of the settlement, the first instalment of Rs.2,00,000/- is agreed to be paid today. The petitioner is ready to make the payment of Rs.2,00,000/- in cash as he is unable to take the Demand Draft from the Bank. The respondent is ready to accept the cash of Rs.2,00,000/-.
3. In view of the submissions, the petitioner is permitted to hand over the cash of Rs.2,00,000/- to the respondent in presence of both the counsels.
4. A sum of Rs.1,00,000/- which is in the Court deposit shall be released to the respondent on proper identification.
5. In view of the settlement between the parties before the Mediation Centre, the present petition do not survive for consideration. Accordingly, the petition is disposed of in terms of settlement arrived at the Mediation Centre.
