ORDER:
This writ petition is flied for a mandamus to set aside order in Rc.No.735/D/06, dated 10.07.2013, of respondent No.3, whereby it has directed the petitioner to close coastal aquaculture activity in R.S.Nos.974/1,2,3, 975/1,2,3 and 976/1,2 of Kodurukandriga Village, T.P.Gudur Mandal, SPSR Nellore District.
At the hearing, Sri P.Sridhar Reddy, learned counsel for the petitioner, fairly admitted that his client did not have any permission for carrying on brackish water aqua culture in the above-mentioned survey numbers and that on a mistaken impression that the permission was obtained by him in respect of other survey numbers also covers the above-mentioned survey numbers, his client has filed this writ petition. He has further submitted that after filing of the writ petition, his client has made an application before the competent authority i.e., District Aqua Culture Committee (Fisheries), SPSR Nellore District, of which respondent No.2 is the Chairman. He has requested for a direction to respondent Nos.2 to 4 to dispose of the petitioner’s application.
In the light of the fact that the petitioner does not possess permission for carrying on brackish water aqua culture, the impugned order cannot be interfered with. However, respondent No.2 is directed to ensure that the petitioner’s application, if any, made for permission is disposed of as expeditiously as possible and not later than three months from the date of receipt of a copy of this order.
Subject to the above direction, the writ petition is disposed of.
As a sequel to disposal of the writ petition, W.P.M.P.No.31135 of 2013 shall stand disposed of as infructuous.
