During the course of arguments learned counsel for the petitioners confined his prayer in the present writ petition to the extent to issue a mandamus commanding the Sub Divisional Officer, Phoolpur/respondent no. 2, to pass final order in respect of the case filed by the respondent no. 6 Ram Kuber Yadav under section 24 of the U.P. Land Revenue Code, 2006 expeditiously.
It appears from the perusal of the record that an application under section 24 of the U.P. Land Revenue Code, 2006 was filed by the respondent no. 6, in the Court of respondent no. 2 in the month of February 2019. In the said case report was also called for from the revenue authorities. It is further contended that in the aforesaid case report was also called for during the revenue authorities in the month of February and March 2019. It is further contended that inspite of the best efforts no decision has been taken by the respondent no. 2 to decide the aforesaid case and as such a mandamus be issued directing the respondent no. 2 to decide the aforesaid case at an early date.
Heard learned counsel for the petitioners and learned Standing Counsel appearing on behalf of State-respondents.
With the consent of learned counsel for the parties, the present writ petition is disposed of finally directing the respondent no. 2 to decide the case no.01654 of 2019 filed by Ram Kuber Yadav against Gaon Sabha and others under section 24 of the U.P. Revenue Code, 2019, expeditiously and preferably within a period of three months from the date of production of certified copy of this order.
With the aforesaid, the writ petition is disposed of finally.
