Kaushik vs Gitaben

High Court Of Gujarat|09 May, 2012

JUDGMENT / ORDER

The petitioner has invoked extraordinary jurisdiction of this Court under Articles 226 and 227 of the Constitution of India against the order dated 22.3.2012 passed by the learned Principal Judge, Family Court, Junagadh, in Criminal Misc. Application No. 123 of 2011, below Exh.27, filed by the wife and minor-daughter for enhancement of their maintenance, under Section 127 of the Code of Criminal Procedure, 1973, by which, the Family Court enhanced the amount of maintenance from Rs.3,000/- to Rs.5,800/- per month to the wife and from Rs.2,000/- to Rs.3,000/- to the minor daughter.
Having heard the learned counsel for the petitioner and on perusal of the record, it is evident that the Family Court considered the earlier order dated 17.4.2009 which is passed before three years, and, considering the day to day scenario of standard of normal living which has become so high, difficult and costly, awarded the enhanced maintenance. Therefore, it cannot be said that the Family Court has committed any error of law or jurisdictional error, which calls for any interference by this Court in exercise of power under Articles 226 and 227 of the Constitution of India. No case is made out to entertain the present petition. This petition is summarily rejected.
