Petitioners had earlier approached this Court by filing Writ Petition No.10711 of 2019, which came to be disposed of on 18.07.2019. Their claim has been considered and rejected by the Commissioner vide order impugned dated 31.10.2019 merely on the ground that no government order has been issued for grant of second promotional pay scale upon completion of 24 years' service.
Order impugned is challenged relying upon a Government Order dated 29.10.2018 in which specific stipulation is made for grant of second promotional pay scale. It is contended that claim of petitioners for second promotional pay scale, therefore, merits consideration in light of the above government order, which has not been noticed.
Writ petition is, accordingly, disposed of with a direction upon respondent no.3 to accord consideration to petitioners' claim for grant of second promotional pay scale, keeping in view the Government Order dated 29.10.2018, within a period of four months from the date of presentation of a copy of this order. Order impugned in the writ petition shall not stand in the way of consideration of petitioners' claim in the event above Government Order is found applicable in the case of petitioners.
