Heard Sri Vikas Rana, learned counsel for the applicant and Sri Bharat Singh, learned counsel for opposite party no.2.
Learned counsel for the applicant has filed supplementary affidavit today stating therein that parties have entered into compromise and the said compromise has been duly verified by the court below on 11.01.2017. Copy of the order of the court below dated 11.01.2017 is annexed as annexure no.1 to the supplementary affidavit.
Learned counsel for the opposite party no.2 states that the matter has been amicably settled between the parties and he does not dispute the contents of supplementary affidavit filed today.
In view of the fact that parties have entered into compromise and settled their dispute amicably, the proceedings of Criminal Case No. 582 of 2001 (State Vs. Kaushal Kishore Bansal) pending in the court of 13th Addl. Chief Judicial Magistrate, Agra, under Section 138 of Negotiable Instrument Act is quashed.
The application is disposed of in terms of compromise.
