Heard learned counsel for the petitioner; learned Standing Counsel for respondent no.1 and Sri Vivek Varma for respondent no.2 Considering the nature of the order that is being passed, this Court does not consider it necessary to issue notice to the respondent no.3 (Committee of Management of Dr. Rishi Kant Siddharth Mahavidyalaya, Sahawar, district Kasganj).
The prayer of the petitioner is that a direction be issued upon second respondent to decide the representation of the petitioner in respect of issuance of mark-sheet of B.A. Part II and B.A. Part III examination given by the petitioner in the year 2015 and 2016 respectively as a regular student of Dr. Rishi Kant Siddharth Mahavidyalaya, Sahawar, district Kasganj.
Sri Vivek Varma, who appears for the respondent no.2, stated that from the documents appended by the petitioner it appears that Admit card issued to the petitioner was hand written and was not downloaded from website of the University and therefore it is quite possible that the petitioner may not be eligible to appear in the examination. However, he submits that all these aspects can be considered by the Examination Controller of the University, therefore the petitioner may be given opportunity to represent her cause before the Examination Controller of the University.
In view of above, without expressing any opinion on the merits of the case, this Court considers it appropriate to dispose off this petition with liberty to the petitioner to represent her cause before the Examination Controller of the University by annexing therewith all the relevant documents to show that she was entitled/eligible to appear in the examination. If any such representation is filed along with certified copy of this order, within a period of two weeks from today, the same shall be considered and appropriate decision shall be taken on the same, in accordance with law, after giving opportunity of hearing to the third respondent, preferably, within a period of next six weeks.
With the aforesaid liberty/direction, the petition is disposed off.
