(Order of the Court was made by the Hon'ble Chief Justice) The learned Special Government Pleader has produced before us the copy of the notice under Section 6 of the Tamil Nadu Land Encroachment Act, 1905 which has been signed by the petitioner. Thus, the very premise on which the petition has been filed is incorrect and we caution the petitioner to be careful in future.
2. The learned counsel for the petitioner seeks to withdraw the petition as he states that the petitioner wants to avail of the appeal remedy. Endorsement has been made.
The writ petition is dismissed as withdrawn. No costs. Consequently, W.M.P.No.880 of 2017 is closed.
