Respondent/Complainant Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to grant anticipatory bail to the petitioner herein in the event of her arrest in Crime No. 55 of 2014 dated 13-02-2014 of Pet Basheerabad Police Station, Cyberabad, Ranga Reddy District pending investigation of the said crime.
The petition coming on for hearing, upon perusing the petition and the Memo of grounds filed herein, and upon hearing the arguments of SRI GADE VENKATESWARA RAO, Advocate for the Petitioner, and of the Public Prosecutor, for the Respondent, the Court made the following
ORDER
The petitioner is the sole accused. She seeks for grant of anticipatory bail. She allegedly committed an offence under Section 420 IPC. The case of the prosecution is that the petitioner borrowed an amount of Rs.5,66,070/- from the de facto complainant and later issued cheques for the said amount. The cheques stood dishonoured. Instead of filing a case under Section 138 of Negotiable Instruments Act, the de facto complainant preferred a complaint under Section 420 IPC.
The learned counsel for the petitioner submitted that no offence under Section 420 IPC is made out and that the case at best would be for an offence under Section 138 of Negotiable Instruments Act. The petitioner is a lady. In view of the amount involved and the nature of the offence alleged and also in view of the sex of the petitioner, I consider it appropriate to enlarge the petitioner on anticipatory bail.
Hence, this Petition is allowed. The petitioner shall surrender before the XV Metropolitan Magistrate, Cyberabad, at Medchal, within two weeks from today. On such surrender, the learned XV Metropolitan Magistrate, Cyberabad, at Medchal, shall enlarge the petitioner on bail on a bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties in a like sum to his satisfaction.
