Today the matter has been posted for dismissal. At 10.35 a.m., the learned counsel appearing for the appellant has sought for pass over and the matter was passed over. When the appeal was called at 11.55 A.M., the learned appearing for the appellant is not ready to argue the appeal and again seeks pass over. Hence, the appeal is dismissed for default. There will be no order as to costs. Consequently the connected M.P.No.1 of 2010 is also dismissed.
