Heard Shri Madan Singh, learned counsel for the applicant and Shri Vineet Pratap Singh, learned counsel holding brief of Shri Vinayak Mithal, learned counsel for the opposite party.
This transfer application has been filed for transferring the Case No. 798 of 2018 (Rahul Gadi Vs. Kashish) filed under Section 9 of the Hindu Marriage Act pending in the Court of Principal Judge, Family Court, Ghaziabad to District Moradabad.
It has been stated in the affidavit that she was threatened and assaulted by the opposite party in Ghaziabad and she has also lodged an FIR in Moradabad. The applicant's father is an old and ailing person and it is very difficult for him to go with the applicant to attend the case in Ghaziabad.
Learned counsel for the opposite party states that he has no objection to the case being transferred to District Moradabad.
In view of the aforesaid, on the ground of convenience of the applicant and in view of the pendency of several cases at Moradabad, the aforesaid Case No. 798 of 2018 (Rahul Gadi Vs. Kashish) filed under Section 9 of the Hindu Marriage Act pending in the Court of Principal Judge, Family Court, Ghaziabad is transferred to District Moradabad.
This application is, accordingly, allowed.
