JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE OF ANDHRA PRADESH AT HYDERABAD THURSDAY, THE SEVENTEENTH DAY OF APRIL, TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE DR JUSTICE K.G. SHANKAR CRL.P.No. 3630 of 2014 Between:
1 Kasam Hari Prasad S/o Lingaiah,
2 Kasam Keerthana W/o Hari Prasad Petitioners/Accused Nos. 8 and 11 AND State of Andhra Pradesh, rep by its Public Prosecutor, High Court of Andhra Pradesh, at Hyderabad through SHO, Nakrekal P.S., Nalgonda District.
Respondent COUNSEL FOR THE PETITIONERS: SRI. P. PRABHAKARA RAO COUNSEL FOR THE RESPONDENT: THE PUBLIC PROSECUTOR Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the memorandum of grounds filed herein, the High Court may be pleased to enlarge the petitioners/accused Nos. 8 and 11 on bail in the event of their arrest in Crime No.21/14 on the file of Nakrekal Police Station, Nalgonda District.
The Court made the following Order:
“Petitioners are A8 and A11. They seek for grant of anticipatory bail. They allegedly committed offences under Sections 406 and 420 IPC. A3, A7 and A9 were already granted anticipatory bail on the ground that they are women. The second petitioner stands on the same footing. I consider it appropriate to enlarge the second petitioner-A11 on anticipatory bail.
Consequently, this Criminal Petition is allowed so far as the second petitioner-A11 is concerned. The second petitioner- A11 shall surrender before the learned Judicial Magistrate of First Class, Nakrekal, within two weeks from today. On such surrender, the learned Judicial Magistrate of First Class, Nakrekal shall enlarge the petitioner on bail on a personal bond of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties in a likesum to his satisfaction.
So far as the first petitioner-A8 is concerned, this Criminal Petition is disposed of giving liberty to the petitioner to surrender before the trial Court and move the trial Court for grant of regular bail. In such an event, the Trial Court shall consider such an application on merits, without being influenced by any part of this order, and shall dispose of the same on the same day on which it is filed.”
