The learned counsel appearing on behalf of the writ petitioner states that the petitioner was entitled for up-gradation to the post of Head Constable on par with his juniors with effect from 25.07.2000 and in this regard, the writ petition has been filed.
2.However, the 3rd respondent/Superintendent of Police, Coimbatore District filed a counter affidavit on 1st October 2010, stated as follows: (d)It is submitted that the date of advancement of upgradation of the petitioner in the rank of Gr.I.PC with effect from 25.07.1995 and subsequent upgradation as head Constable with effect from 25.07.2000 has been considered and ordered by the Superintendent of Police, Thirunelvelli district in D.O.No.683/2010 in C.No.A2/15090/2010 dt:09.06.2010 and consequential pay regulations are on hand at Coimbatore district.
3.In view of the fact that already the benefit of up-gradation has been extended to the writ petitioner and therefore, no further orders are required in respect of upgradation. The learned counsel for the writ petitioner states that the writ petitioner has not paid the consequential monetary benefits in lieu of the upgradation. In this regard, the petitioner is at liberty to submit appropriate representation to the respondents and on receipt of the same, the respondents may consider the same and pass orders in accordance with law.
