Nobody is present on behalf of the appellant to press this appeal. Sri M.M. Maurya holding brief of Sri Ramendra Asthana, learned counsel for the respondent is present.
The delay condonation application was allowed vide order dated 11.2.2015 subject to the payment of cost of Rs. 500/- payable to the respondents but the cost has not yet been paid to the respondents.
Accordingly, Civil Misc. Delay Condonation Application No. 38049 of 2011 is rejected for want of prosecution as well as for not complying with the order dated 11.2.2015.
Consequently, the appeal is dismissed as barred by limitation.
