JUDGMENT / ORDER

For the sake of convenience, the parties will be referred to as the complainant and the accused.
2. The complainant initiated prosecution in C.C.No.38 of 2016 under Section 138 of the Negotiable Instruments Act against the accused in which, the learned Judicial Magistrate, Fast Track Court, Magisterial level, Vellore acquitted the accused by order dated 16.05.2017. Aggrieved by the order of acquittal, the complainant preferred the present appeal with a special leave petition.
3.Private notice has been served on the accused and her name is printed in the cause list. However, court notice has not been served and the accused has not entered appearance through advocate.
4. In view of the judgment of Full Bench of this Court in S. Ganapathy vs N. Senthilvel reported in (2017) 3 MLJ (Crl) 641 (FB), the Registry is directed to transmit all the papers to the Principal District and Sessions Judge, Vellore, within a period of four weeks from the date of receipt of a copy of this judgment, after taking photocopy of the papers on file.
5. The complainant is directed to appear before the learned Principal District and Sessions Judge, Vellore, on 11.12.2017 at 10.30 a.m. 08.11.2017 Index : Yes/No Internet : Yes To
