JUDGMENT / ORDER

Today, when the matter came up for hearing, the learned counsel for the petitioner submitted that the conditional order passed by this Court dated 19.12.2016, has not been complied with by the petitioner.
2.To show the bona-fide of the petitioner, this Court, on 19.12.2016, has directed the petitioner to pay a sum of Rs.50,000/- to his ailing poor mother, that too, having constructed 400 sq.ft area of the subject property, spending a sum of Rs.10 lakhs and also stated before this Court that he is going to construct about 100 sq.ft area exclusively for his mother's use.
3.Considering the fact that though the petitioner being a mason by profession and also financially well, has not chosen to pay his mother as directed by this Court and also taking into account, there is no merits on the facts of the case, the Writ Petition stands dismissed. Consequently, connected Miscellaneous Petition is also closed. No costs. 19.01.2017 Index:Yes/No DP To
