A.M.Shaffique, J. This writ petition is filed seeking police protection. According to the petitioner, respondents 2 to 6 are continuously threatening him and there is danger to his life. Though it is stated that Ext.P1 complaint is filed, police has taken no action in the matter.
2. According to the petitioner, he executed a Will bequeathing certain property in the name of his grand daughters. This created animosity by sixth respondent. The sixth respondent is his wife, the third respondent is a close relative and respondents 4 and 5 are his children.
3. A counter affidavit is filed inter alia indicating that the sixth respondent is living in the building, which is owned by the petitioner. She is residing there along with her daughter’s son. Other children of the petitioner are not living in the said house. They are living far away. According to them, the intention of the petitioner is to evict the sixth respondent and her grandson from WP(C) No. 23627/14 2 the house, in which she is residing. It is stated that the sixth respondent has no other place other than the said house. In Ext.P1 complaint, the petitioner had stated that he was forcibly taken to the mental hospital.
4. Learned Government Pleader submits that there is no law and order situation in the matter relating to the complaint raised by the petitioner, where as it is a family dispute.
5. Having regard to the aforesaid factual issues, we observe that family disputes are to be resolved in appropriate proceedings. Police cannot interfere in such issues and therefore we do not think that any direction can be issued as prayed for. If there is any offence committed, it shall be open for the petitioner to approach the police, in which event the police will look into the same and do the needful.
The writ petition is disposed as above.
