Heard.
2. The grievance of the petitioner in this writ petition is that his application, dated 03.03.2008 for grant of quarry lease for balck granite in Survey No.87 of Yellmanda Village, Narasaraopet Mandal, Guntur District, is not being considered by the Assistant Director of Mines & Geology, respondent No.3. Petitioner himself has produced along with the writ petition the proceedings of respondent No.3 addressed to the Tahsildar, Narsaraopet, dated 03.03.2008 requesting for examining the petitioner’s application for the purpose of granting no objection certificate so far as revenue department is concerned.
3. Learned counsel for the petitioner submits today that the Tahsildar has already issued no objection certificate and the same is forwarded to respondent No.3.
4. Learned Government Pleader for Mines submits that since the recommendations of the Tahsildar were not received, no action could be taken on the petitioner’s application.
5. Since it is reported the Tahsidlar has already sent his no objection certificate to respondent No.3, taking that into consideration, the writ petition is disposed of directing respondent No.3 to consider petitioner’s quarry lease application, as above, after examining the report of the Tahsildar, Narsaraopet, and shall pass appropriate orders on the said application preferably within thirty (30) days from the date of receipt of communication of report from the Tahsildar, Narsaraopet.
With the above direction, writ petition is disposed of.
As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
