Heard Sri Ram Singh Kushwaha, learned counsel for the applicant and Sri Rajesh Mishra learned A.G.A. for the State and perused the record.
It has been contended by the learned counsel for the applicant that the applicant is facing trial in the present case and the eye witnesses of the case have turned hostile and have not supported the prosecution case. It has been further submitted that the applicant is an old man aged about 68 years and is also a heart patient. The applicant is in jail since 25.7.2015.
Learned A.G.A. have vehemently opposed the prayer for bail and submitted that there appears to be no medical report of the applicant that he is the heart patient.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Virendra Singh @ Veeray involved in Case Crime No. 492 of 2015 under Section 302 I.P.C., police station Civil Line District Etawah.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within preferably a period of four months from the date of production of a certified copy of this order, if, there is no legal impediment.
