JUDGMENT / ORDER

1. By way of this petition, the petitioner has prayed for a direction to respondents to place him in the time scale salary and further not to terminate the services of the petitioner without following due procedure under the law.
2. After having heard learned advocates appearing for the respective parties and after having considered the submissions and the resolutions placed on record, the Court is of the view that since there is no vacant post, the Court cannot issue direction to make the petitioner permanent. However, since the petitioner is performing his duty for the last more than 21 years as a part time Sweeper, it would be appropriate that the respondent authorities consider the case of the petitioner in light of the Resolutions which are produced on record and in light of the directions issued by this Court in respect of similarly situated persons and take appropriate decision in the matter. It is, therefore, observed that, if any representation is made by the petitioner regarding subject matter, the authority concerned shall decide the same keeping in mind the resolutions and the directions of this Court passed in respect of similarly situated persons, within a period of three months from the date of receipt of such representation.
3. With the above observations and directions, the present petition stands disposed of. Direct service is permitted.
