. Respondent Petition under Sections 437 & 439 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to enlarge the petitioner on bail in Crime No. 125 of 2014 on the file of the Jeedimetla Police Station, Hyderabad.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of M/s Indus Law Firm, Advocate for the Petitioner and of the Public Prosecutor for the Respondent, the Court made the following.
ORDER:
“The petitioner is A-1. He seeks for grant of bail. He allegedly committed offences under Sections 417, 420, 312, and 314 and 304-A read with Section 109 IPC and under Section 5 of Medical Termination of Pregnancy Act, 1971.
The victim girl was said to be in love with the petitioner and on account of the forcible termination of pregnancy, the victim girl died. The petitioner has been in jail since 24.2.2014. The admitted fact is that the petitioner and the victim girl were in love with each other. 16 witnesses have been examined by the investigating agency including the official witnesses, as can be seen from the remand report. In view of the stage of the investigation and the nature of the offences alleged, I consider it appropriate to enlarge the petitioner on bail.
Accordingly, this Criminal Petition is allowed. The petitioner is enlarged on bail on a personal bond of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties in a likesum to the satisfaction of the learned VI Metropolitan Magistrate, Cyberabad, Medchal.”
