This petition under section 24 of the Code of Civil Procedure is filed by the petitioner seeking transfer of M.O.P.No.130 of 2012 from the file of Additional Senior Civil Judge’s Court, Srikakulam, to Senior Civil Judge’s Court, Ramachandrapuram, East Godavari District.
Heard both sides.
Petitioner-wife seeks transfer of the case filed by the respondent- husband for dissolution of marriage, on the ground that after the respondent deserted her, she has been staying at Kotturu Village, Anaparthi Mandal, East Godavari District, along with her parents and as such she is facing difficulty in attending the Court at Srikakulam to defend the case filed by her husband.
In Sumita Singh v Kumar Sanjay[1] the Hon’ble Supreme Court held that in matrimonial matters, convenience of the wife has to be taken into consideration.
Considering the above circumstances, this petition is allowed and M.O.P.No.130 of 2012 is hereby withdrawn from the file of Additional Senior Civil Judge’s Court, Srikakulam, and transferred to Senior Civil Judge’s Court, Ramachandrapuram, East Godavari District, for disposal in accordance with law.
Miscellaneous petitions pending in this petition, if any, shall stand closed.
