HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY WRIT PETITION No.40291 of 2014 Date:29.12.2014 Between:
Karneti Jhansi Rani, W/o Ramesh . Petitioner And:
The State of Telangana., reptd by its Principal Secretary, Civil Supplies Department, Hyderabad and three others.
. Respondents Counsel for the Petitioner: Smt Mummaneni Sai For Sri Mummaneni Srinivasa Rao Counsel for the Respondents: GP for Civil Supplies (TS) The Court made the following:
ORDER:
This Writ Petition is filed for a Mandamus to set aside proceedings in Rc.No.1-719/2009, dated 20.06.2009, of respondent No.3 issued purporting to suspend the petitioner’s fair price shop authorization.
After hearing learned counsel for both the parties, I am of the opinion that no relief other than directing respondent No.3 to complete the enquiry and pass a final order can be granted, at this stage, for, the impugned proceedings were issued as far back as 20.06.2009 and the petitioner has approached this Court 5 ½ years later.
In this view of the matter, the Writ Petition is disposed of with a direction to respondent No.3 to hold a detailed enquiry following the procedure explained in Smt B.Manjula Vs. District Collector, Civil Supplies, Kur nool (Writ Petition No.32713 of 2011, dated 26.11.2014), pass a final order and communicate the same to the petitioner within six weeks from the date of receipt of a copy of this order. In order to enable respondent No.3 to follow the said judgment, a copy thereof shall be enclosed.
As a sequel to disposal of the Writ Petition, W.P.M.P.No.50535 of 2014 filed by the petitioner for interim relief is disposed of as infructuous.
