The contention of the petitioner is that the construction was made after the execution of the gift deed and, therefore, the value of the construction cannot be taken into account. There is no contrary material on record. Even the report of the S.D.M., Bijnor dated 21.5.2008 does not say that the construction was made prior to the date of gift deed.
Learned Standing Counsel has accepted notice on behalf of all the respondents. He prays for and is granted four weeks time to file counter affidavit. Rejoinder affidavit may be filed within two weeks thereafter.
List thereafter.
Till the next date of listing, the recovery in pursuance of the order dated 11.6.2010 passed by the Collector (Stamp), Bijnor in case no.111 of 2007 (State Vs. Neeraj Kumar Agrawal) shall remain stayed.
