H.C.Kavitha, HCGP) This Writ Petition filed under Articles 226 and 227 of the Constitution of India, praying to direct the respondent No.1 Authority to consider the representation dated 29.01.2018 vide Annexure-C, consequently and etc., This Writ Petition is coming on for Preliminary Hearing in ‘B’ Group, this day, the Court made the following:
O R D E R The petitioner-KSRTC is before this Court seeking for a direction to the respondent No.1- Authority to consider the representation dated 29.01.2018, submitted by the Corporation.
2. It is the grievance of the petitioner that respondent No.1 – Authority which is obligated to implement the dictum of the Hon’ble Apex Court in the case of G.T.VENKATASWAMY REDDY VS STATE TRANSPORT AUTHORITY AND OTHERS reported in (2016) 8 SCC 402 ought to have given decision with regard to the permits operating on the interstate routes in violation of the schemes which is otherwise prohibited. The inaction of the Authority in not placing the subject relating to the issue on hand has compelled the petitioner to file this writ petition.
3. The learned HCGP for respondents fairly submits that there is no legal impediment for the respondent-Authority to consider the representation dated 29.01.2018 submitted by the petitioner in accordance with law within a time frame.
4. In view of the aforesaid, this Court is of the considered opinion that the interest of the justice would be sub served directing respondent No.1- Authority to consider the representation of the petitioner dated 29.01.2018 at Annexure-C to the writ petition in accordance with law and take a decision in an expedite manner, in any event, not later than eight weeks from the date of receipt of certified copy of the order. Ordered accordingly.
With the aforesaid observations and directions, this writ petition stands disposed of.
