CONCILIATION ORDER In this petition, the petitioner has prayed for quashing the order dated 28.07.2011 in No. PGA/SR/71/2007-08 passed by the by the Assistant Labour Commissioner and Controlling Authority – 2nd Respondent vide Annexure ‘C’.
2. After negotiations, the parties have arrived at settlement. According to the settlement, the petitioner – Karnataka State Road Transport Corporation has agreed to pay and the respondent No.3 – Claimant has agreed to receive a lump-sum of Rs. 15,000/- (Rupees Fifteen Thousand only), in full and final settlement of the claim of respondent No.3 towards payment of gratuity. A Joint Memo is filed on behalf of the parties to this effect.
3. The entire amount as agreed by the parties, shall be released in favour of the respondent No.3 on deposit made by the petitioner, on proper identification and the remaining amount if any, shall be released in favour of the petitioner - Corporation.
4. Accordingly, the Writ Petition is disposed of modifying the Order dated 28.07.2011 passed by the 2nd Respondent. In view of the settlement arrived at between the parties in W.P. No. 46907/2014, the W.P. No. 2785/2013 filed by the claimant is dismissed as withdrawn.

Labour Commissioner and Controlling Authority bearing No.PGA/SR/71/2007-08 dated 28.07.2011 and the order passed by the Deputy Labour Commissioner dated 17.07.2012 in DYLCH-1/PGA/SR/26/2011-12. The Writ Petition has been referred to this Lok Adalat by the Hon'ble High Court U/S.20 of the Legal Services Authorities Act.1987. The contested parties to the petition have settled their claim before the Lok Adalat on the following terms:
The petitioner & respondent 3 being the contested parties to the proceedings have agreed to settle the case. The petitioner has agreed to pay a lump-sum of Rs.15,000/- (Rupees Fifteen Thousand only), in full and final claim of the respondent No.3 towards payment of gratuity and the respondent No.3 has agreed to receive the same in the above terms. The amount agreed as above be released in favour of the Respondent No.3 from the deposit made before the Asst. Labour Commissioner and the remaining amount be released in favour of the petitioner – Corporation. W.P. No.2785/2013 is dismissed as withdrawn.
The parties to this petition have set their hands to this settlement before the Lok Adalat in the presence of Conciliators on this 22.09.2017 at Bengaluru Bench.
