THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT APPEAL No. 1415 of 2014 JUDGMENT: (Per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) This appeal has been preferred against the judgment and order of the learned Single Judge dated 25.08.2014 by which His Lordship was pleased to dismiss the writ petition.
The writ petition was filed assailing the action of the Greater Hyderabad Municipal Corporation in not taking action against the unofficial respondents who are alleged to have been made illegal construction without any sanctioned plan. When the writ petition was heard out finally, it was brought to the notice of the learned Single Judge that permission had already been granted.
Learned counsel for the appellant says that during the pendency of the writ petition permission was granted and such permission is illegal, and particularly, it appears from the interim order that the respondent - Corporation wanted to take action against the unauthorized and illegal construction, but instead of taking such action granted permission. He further submits that separate writ petition has been filed already.
Under these circumstances, we close this appeal without deciding the matter. All points are kept open to be agitated in the subsequent writ petition.
Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
