THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 28455 of 2008 ORDER: (Per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) Looking at the prayer we are of the view that the 1st respondent should not have referred this matter at the first instance. There are only four respondents, but the prayer has been made against the 5th respondent. It is total non- application of mind of everyone and on that ground itself the writ petition is liable to be dismissed. That apart a reading of the counter filed by the official respondents we find that the unofficial respondent has not occupied any of the land in Sy.No.102 as complained. This counter affidavit was filed by the Tahsildar concerned on 11.02.2009 and no reply has been filed.
Hence, the writ petition is closed without passing any order.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
